Terms of Use

These terms are the agreement between you and I-nspire Transformations for the STILL app and the stillsanctuary.app website. By requesting access, signing in, downloading the app, playing anything from the library, or posting a note, you agree to them. If you do not agree, please do not use STILL.

Website: stillsanctuary.app. STILL is a guided audio and journalling application. The app and site are built and maintained for us by Asan Digital.

This section is provided as required by section 43 of the Electronic Communications and Transactions Act, 2002.

2. What STILL is — and is not

STILL provides guided audio, meditations, music and a private journal. It is intended for general wellbeing and personal reflection.

STILL is not a medical, clinical, diagnostic, therapeutic or emergency service. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for care from a qualified professional. Never disregard or delay professional advice because of something you read or heard in STILL. If you are in crisis, contact your local emergency service, or in South Africa the South African Depression and Anxiety Group on 0800 567 567.

Do not use audio content while driving or operating machinery. Some content uses sustained tones and steady rhythms; speak to your doctor first if you have epilepsy or a seizure disorder, a neurological condition, a heart condition or a pacemaker, or if you are pregnant. If you feel unwell or uneasy at any point, stop. The full caution is set out in Before you listen.

3. Keep your own copy

Software can lose data — through a bug, a failed update, a lost or reset device, or an account deletion. Do not rely on STILL as the only copy of anything that matters to you.

STILL is currently offered free of charge in a private, invitation-only beta. If you are a beta tester, the STILL Beta User Agreement applies to you as well as these terms, and it governs where the two differ.

4. Your account

You must be 18 or older to use STILL. You need an email address to sign in — we send a one-time link rather than using passwords. Accounts are personal to you. Keep your sign-in link and your mailbox secure, and do not share access; anything done through your account is treated as done by you. Tell us immediately at jacque@i-nspire.co.za if you think someone else has access.

Give us an accurate email address. Access is granted at our discretion and is not transferable.

5. Your licence to use STILL

We give you a personal, non-exclusive, non-transferable, revocable licence to use the STILL app and library for your own private, non-commercial use, for as long as these terms are in force. That is a licence to use it — we are not selling you the software or the content, and we keep all rights we do not expressly give you here.

All audio, music, voice recordings, meditations, artwork, text, design and software in STILL are owned by I-nspire Transformations or licensed to us, and are protected by copyright and other laws. The STILL name and mark are ours. Nothing in these terms transfers any of that to you.

Shared library pages are made public so you can share a link. Sharing the link is welcome. Copying the audio itself is not.

7. Reactions and notes you post

Some library pages let you leave a reaction or a short note. These are public — anyone who visits the page can read them. Please do not post anything private, about yourself or anyone else.

You keep ownership of what you write. By posting it you give us a free, worldwide, non-exclusive licence to store, display and share it on and around STILL, for as long as it stays up. You confirm what you post is yours to post.

Do not post anything that is unlawful, hateful, harassing, threatening, discriminatory, obscene, spam, advertising, someone else's personal information, or medical claims. We use an automatic filter and we may remove anything, at our discretion, without notice or explanation. We are not obliged to monitor posts, and we are not responsible for what other people write. You can ask us to remove your own note at any time by emailing us.

8. Availability

We try to keep STILL running, but we do not promise it will be available, uninterrupted or error-free. We may suspend it for maintenance, change it, or withdraw features. We will give reasonable notice for planned changes where we can.

9. Liability

To the fullest extent the law allows, STILL is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of data, or loss arising from your use of or inability to use STILL, from anything you read or heard in it, or from anything another user posted. Where liability cannot be excluded, our total liability to you for all claims is limited to the greater of the amount you have paid us in the twelve months before the claim, or ZAR 1 000.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or for gross negligence. If you are a consumer, your rights under the Consumer Protection Act, 2008 in South Africa, or under mandatory consumer law where you live, are not affected by anything here.

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of STILL, or anything you post.

10. Suspension and ending your access

You can stop at any time — delete the app, and if you want your account removed, follow Delete your account. We may suspend or end your access if you break these terms, if we reasonably believe you are misusing STILL or putting others at risk, or if we stop offering the service. Sections 6, 7, 9 and 12 survive the end of this agreement.

11. Privacy

How we handle personal information is set out in our Privacy Policy and Cookie Policy, which form part of these terms.

12. Law and disputes

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. If you are a consumer resident in the EU or UK, this does not deprive you of the protection of the mandatory laws of your own country, and you may also bring proceedings there.

Please contact us first — most disputes are resolved with an email. South African consumers may also refer a complaint to the National Consumer Commission or an accredited consumer ombud.

13. App store terms

If you install STILL through the Apple App Store or TestFlight, this agreement is between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance, and is not responsible for any claim about the app, including product liability or intellectual property claims — those are our responsibility. You confirm you are not in a country subject to a US embargo or on a US restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. You must also comply with Apple's own terms of service.

If you install through Google Play, Google's terms apply to the download in the same way, and Google is not a party to this agreement.

14. General

We may update these terms; the date at the top shows when. If a change materially affects you, we will tell you by email or in the app before it takes effect, and continuing to use STILL after that means you accept it. If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to do so later. These terms, with the Privacy and Cookie Policies, are the whole agreement between us. You may not transfer your rights under them; we may transfer ours if our business is transferred.
